Passengers contracting the services of Liberty Balloon Flights (LBF) do so under the following terms and conditions:
1. Operator
Liberty Balloon Flights Pty Ltd (LBF), ACN 624461623, operates under Air Operators Certificate number CASA.TAAOC.0967 and is bound by legislation under the Civil Aviation Safety Authority of Australia (CASA).
2. Fares
Prices are in Australian Dollars and reflect the cost of the flight up to and including 31st March of the year of purchase. Prices may vary at any time, and the final price is confirmed at checkout.
- 2.1 Currency: Prices are in Australian Dollars, and any refunds will be in Australian Dollars. LBF accepts no responsibility for currency fluctuations.
3. Alterations, Rescheduling, and Cancellations
- LBF must be notified by telephone or email of any cancellation or rescheduling requests.
- 3.1: More than 72 hours before flight departure, a flight may be rescheduled. No cancellations or changes are permitted within 72 hours. A cancellation fee of $25 per person applies for cancellations outside of 72 hours.
- 3.2: Passengers are recommended to arrange their own insurance for unforeseen circumstances, including inability to fly due to illness.
- 3.3 No Show: If passengers cancel or fail to appear on the morning of the scheduled flight, no refunds or rescheduling will be permitted. Passengers may send a replacement, provided LBF is notified before the flight date.
- 3.4: No refunds are available for trips booked with a gift certificate (see Section 4).
- 3.5: Separate cancellation and alteration provisions apply to large groups and customized events. LBF reserves the right to amend fees and notice periods. Special circumstances may be superseded by terms in the booking confirmation documentation.
- 3.6: Passengers who have lost their flights may reactivate their tickets for $150 per ticket, subject to availability, passenger numbers, and LBF’s sole discretion.
4. Gift Certificates
Gift certificates are valid for 36 months from the date of purchase and must be fully paid to be valid. They are non-redeemable for cash and non-refundable in part or in full. Certificates are transferable to other individuals and valid only for the period indicated. Once redeemed (i.e., a trip date is booked), Section 3 terms apply, and the value remains non-refundable. Extension fees: 6-month extension – $75 per person; 12-month extension – $100 per person.
5. Cancellations Due to Weather
If LBF cancels a flight due to weather, passengers may rebook at no extra charge within 12 months. If passengers attempt to fly three or more times within this period, LBF will endeavour to honour the booking for an additional 6 to 12 months, depending on location.
6. Refunds for Direct Bookings
Refunds for flights booked directly through LBF incur a $25 per person administration fee, up to a maximum of $200 per booking. Vouchers, gift cards, and discounted tickets are non-refundable.
7. Refunds for Agent Bookings
Refunds for tickets purchased through an agent must be obtained directly from the agent, who may retain booking fees up to 100% of the price at their discretion.
8. Booking Processing and Payment
Bookings can be made by telephone, email, or on the LBF website. A booking is confirmed only upon issuance of a confirmation reference number. Unpaid bookings will be cancelled 72 hours before travel.
9. Preparing for Your Flight
Hot air ballooning involves outdoor activities, including take-off and landing in potentially uneven fields. Passengers must dress in practical clothing and sturdy footwear, as fields may be wet or muddy. Participation in balloon setup and packing is encouraged but not mandatory. Landings may be bumpy, and the basket may tip, leaving passengers horizontal briefly. Contact LBF with any concerns.
10. General Mobility
Passengers must be able to climb in and out of the basket (approximately 1.2 meters high) unaided, using footholds and steps provided. LBF staff will supervise, but the pilot’s decision on passenger fitness is final.
- 10.1 Less Abled Passengers: Less-abled persons should seek medical advice before booking. CASA rules may prohibit certain disabled persons from flying for safety reasons. Passengers participate at their own risk, and LBF accepts no liability for damage or injury.
- 10.2 Pregnant Persons: Pregnant persons are recommended not to fly and should consult a doctor before travel.
11. Medical Conditions
Passengers with medical conditions must confirm suitability to fly before booking and notify LBF staff. As tours may last over 4 hours, passengers should carry necessary medication. Participation is at the passenger’s own risk, and LBF accepts no liability for damage or injury.
12. Alcohol and Drugs
Passengers impaired by alcohol, drugs, or prescription medication, or whose behaviour disrupts others, will not be permitted to fly.
13. Carriage at Pilot’s Discretion
The pilot has absolute discretion to decide whether a passenger may fly, prioritizing safety. LBF accepts no liability for inconvenience or damage caused by such decisions.
14. Minimum Age Requirement
Children must be at least six years old to fly. Children up to twelve years old must be accompanied by a responsible adult.
15. Flight Times
Flights operate early in the morning, close to sunrise, and rarely near sunset. LBF cannot guarantee being airborne at sunrise or that weather conditions will ensure favourable views.
16. Flight Duration
Flights last approximately one hour, though duration may vary due to weather or landing availability, at the pilot’s discretion.
17. Disclaimer
Passengers participate at their own risk. LBF accepts no liability for any loss, claim, injury, or damages arising from participation.
18. Photographs, Filming, and Media
LBF provides photography and filming services. Passengers assign all copyright to LBF and grant the right to use images in any medium for any reasonable purpose without compensation or notification.
19. Personal Items
Personal items are carried at the passenger’s risk. Bags and backpacks are not permitted on the balloon due to weight and safety restrictions.
- 19.1: Passengers are advised not to bring valuables.
20. Payment Methods
Payments can be made by cash, direct deposit, Visa, Mastercard, or other methods available on the LBF website.
21. Credit Card Declined
If a payment cannot be authorized three days before travel, the booking will be cancelled. LBF will attempt to contact the customer for alternative payment, but bookings will not be held without a confirmed payment and reference number.
22. Travel Agent Vouchers
Acceptance of travel agent vouchers depends on the agent’s good credit status with LBF.
23. Industry Partners
Due to operational needs, passengers may fly with an industry partner, or partner passengers may fly with LBF. All partners hold appropriate permits and insurance.
